Katie Holmes has denied reports she filed for an emergency custody and child support following news she is divorcing Tom Cruise.

Her lawyer released a statement today following claims she had asked a judge for an 'emergent application' which would have seen her come face to face with Tom for the first time since their split was announced five days ago.

Katie, 33, has asked for sole legal custody of their six year old daughter Suri.

But her lawer Jonathan Wolfe told People.com: 'Other than her action for divorce, the only pending application filed by Ms Holmes remains her request for an anonymous caption,' he said, referring to how she wants the papers in the case to be filed anonymously.

Cruise is yet to file any legal papers. The actor turned 50 yesterday and flew from Iceland where he is filming to Los Angeles, spending the occasion with his adopted children Isabella and Conner from his marriage to Nicole Kidman.

A source told People that he want to file papers in Los Angeles, which he considers his home, rather than in New York.

The insider said that despite having an apartment in New York, the family primarily spent time in the Big Apple for work purposes.

'They don't live in New York City. It's ridiculous.' the source is quoted as saying.

It was reported earlier that a hearing for the emergent application had been set for July 17, according to HollywoodLife.com.

A source allegedly told the website: 'Katie filed an ‘emergent application’ in New York City on July 3.'

Both of the Hollywood stars, who were married for almost six years, would be required to appear in court on the aforementioned date before Judge Matthew Cooper, HollywoodLife claimed.

The website claimed Katie’s attorney Allan Mayefsky filed for the custody and child support hearing yesterday.

Tom is being represented by one of Los Angeles top divorce lawyers Dennis Wasser.

Well-known legal analyst and author Lisa Bloom told website The Daily Beast: ‘She's making it clear she's going to play tough. Cruise is more of a high-profile celebrity than she is, so he has a greater distance to fall if grievances are aired.

‘Everyone has dirty laundry they don't want aired. She's saying play fair with me or else. Of course she would choose an experienced and tough lawyer.

‘But the fact that she'd choose someone who's been known to go to media in the past signals that she might have hired him for that reason.’

Katie's fears that daughter Suri was set to be inducted into a hardcore Scientology organisation were the driving force behind the end of her marriage to Hollywood star Tom Cruise.

The actress was allegedly convinced husband Tom Cruise was planning to send Suri, six, away to Sea Organisation -  an association of Scientologists established in 1968 by L. Ron Hubbard, the science fiction writer and founder of Scientology.

Sea Org, as it is known, is where the highest levels of Scientology are taught and children as young as five can be sent to live there - without their parents.

I truly get sick to my stomach knowing that this young lady, who is just trying to just protect her daughter and have as normal life as possible, is so hounded by the damn crazy paparazzi, no matter where she goes. I hope she will be strong enough to cope with this whole thing, as well as her little child. Somehow I feel that there will be issues to deal with for them both down the road.......... In any case, Ms. Holmes, my prayers are with you and your little girl. Hang in there. Good to know your own family is there for you.

Katie has blossomed into a very strong woman in the past few days. I have been critical of her in the past and am now prepared to admit I was wrong. I hope the courts see things her way and give primary custody of Suri to Katie.

She had to feel she had a legitimate reason for all the secrecy surrounding her filing for divorce. Much has been said about Tom Cruise, his beliefs and the way he seemed to want to control her. People don't plan a daring escape unless they feel threatened...keep your chin up Katie.

It's scary that Tom won sole custody of his children with Nicole Kidman who didnt even get joint custody, something was very odd there. Katie needs to be strong and it's evident she's a smart girl and has prepared for this well. She looks like a great mother too!

I don't see Tom doing what he is being accused of since he didn't with Isabelle or Connor and they seem like fine young adults! Anyway, I am glad that Suri is learning about Jesus! I wish them all the best and am praying for them.

She must attack, attack, attack and never stop...if she gives him an inch of a chance he will destroy her.

Everyone is feeling so sorry for Katie and wanting her to protect her child....are we to believe that this full grown woman had not one clue about Scientology or it's beliefs??? She converted to it. She knowingly married a Scientologist, she became one and now all of a sudden she has to escape??? If that IS the case, then just how naive was she???? Did her and Tom not discuss anything together? I feel bad for her if she's unhappy but how did she not know about what was in store for her and Suri??

Really sad to see so many people giddy with delight at the thought of a child being taken away from her father. I am NO fan of his church but exactly how bad did his other children turn out that he deserves no part in Suri's life?

As far as I can tell, the two other Cruise children, Isabella and Conner, have turned out to be two upstanding citizens! He's parented both of them since early childhood. So what is all the hoopla over him being a parent to Suri about?? I think Team Holmes is in overdrive at the moment.

I've read a lot about Scientology today and have yet to see any proof of it being a positive influence in people's lives. Why don't they speak out about this negative press?
